Second Violation -- Category I After confirmation of the second violation the student shall: 1. Face suspension of 3 to 5 days or possible expulsion from school. 2. Lose eligibility for the next 6 consecutive inter-scholastic events in which the student is a participant. 3. Participate in a counseling program or a treatment program before student is allowed to return to the activity. 4. Student and family must get professional assessment for potential chemical abuse or misuse. 5. Attend a mandatory meeting between his/her parents or guardians, administrator, and Executive Board
Third Violation -- Category I 1. Student will be expelled from school and thus no longer will be involved in school activities.
Category 2 Activities 1. Penalties will be the same for student suspension and expulsion but will be determined on an individual basis for penalties for the participation in the activities. Student must attend a meeting between his/her parents or guardians, administrator, and Executive Board.
Per South Dakota Codified Law 13-32-9 SUSPENSION FROM EXTRACURRICULAR ACTIVITIES FOR CONTROLLED SUBSTANE VIOLATIONS Any person adjudicated, convicted, or the subject of a suspended imposition of sentence for possession, use, or distribution of controlled substances or marijuana as defined in chapter 22-42 is ineligible to participate in any extracurricular activity at any secondary school accredited by the Department of Education and Cultural affairs for one year. Upon a subsequent adjudication, conviction, or suspended imposition of sentence for possession, use or distribution of controlled substance or marijuana by a court of competent jurisdiction, that person is ineligible to participate in any extracurricular activity while attending any accredited school in South Dakota.
